LIABILITY WAIVER AND RELEASE FROM CLAIMS

I, the undersigned adult participant and/or parent/legal guardian of the minor children under my care, in relation to the Event hosted by RED Church, Inc. (“RED CHURCH”), acknowledge and agree as follows:

1.      Assumption of Risk

I acknowledge and understand that my participation (and participation of the minor children under my care) involves inherent risks of bodily injury, illness, property damage, and, in rare circumstances, death as a result of uneven ground, allergies, or any of the games or attractions associated with the Event. I knowingly, voluntarily, and expressly assume all such risks, whether known or unknown. These risks include falls, collisions with other participants, and injuries associated with jumping, bouncing, or using inflatables and other equipment. I acknowledge these risks and voluntarily choose to participate.  I accept full responsibility for my conduct and the supervision of the minors under my care. I agree to follow posted rules and reasonable instructions from Event personnel, including applicable age, height, weight, capacity, and other restrictions for games and attractions. I will instruct the minor children under my care to follow these rules and instructions. Children must remain accompanied and supervised by a parent or responsible adult throughout the Event. The Event does not provide drop-off childcare. I am responsible for arranging and maintaining that supervision for the minor children under my care. I am responsible for inspecting treats before consumption by me or the minor children under my care and for determining whether they are suitable in light of known allergies or dietary restrictions. I agree to remain in designated Event areas, follow parking and pedestrian directions, and promptly report injuries or unsafe conditions to Event personnel.

2.      Release and Waiver

In consideration of being allowed to participate, and to the fullest extent permitted by the laws of the Commonwealth of Virginia, I hereby release, waive, discharge, and covenant not to sue RED CHURCH, its pastors, officers, directors, employees, volunteers, agents, and affiliates (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, or liabilities arising out of or related to my participation (or the participation of the minor children under my care) in the Event, including those caused by the ordinary negligence of the Released Parties, whether the resulting injury or loss is known or unknown, foreseen or unforeseen, and whether presently existing or arising in the future.

This release and the indemnification obligations in Section 3 do not extend to gross negligence, willful or wanton misconduct, or intentional wrongdoing on the part of any Released Party, and neither provision waives any right or imposes any obligation that may not lawfully be waived or imposed under Virginia law.

Should any provision of this Liability Waiver and Release of Claims be held unenforceable, the remaining provisions shall continue in full force and effect. 

3.      Indemnification

I further agree to indemnify, defend, and hold harmless, to the fullest extent permitted by the laws of the Commonwealth of Virginia, the Released Parties against any claim asserted by me or by and of the minor children under my care for whom I am the parent or legal guardian, and against any claim arising out of my own conduct at the Event, including damage caused by me to the premises or to the property of others.

4.      Medical Treatment

In the event of an emergency, I authorize the Released Parties to obtain necessary medical treatment for me or the minor children under my care through contacting emergency medical services. I accept financial responsibility for any such treatment.

5.      Photo/Video Release

The Event will be photographed, filmed, and otherwise recorded. I grant RED CHURCH permission to photograph or record me (or the minor) during the Event and to use such images for church-related purposes (newsletters, website, social media, etc.) without compensation.

6.      Acknowledgment

I have read this waiver carefully, understand its contents, and sign it voluntarily. I understand that I am giving up substantial legal rights. If signing for a minor, I represent that I am the parent or legal guardian with authority to do so.
